The 1031 Exchange

Investors who sell their real estate property are often deterred due to the high rate of capital gains they may be responsible for paying. However, per Internal Revenue Code (IRC) Section 1031, these investors can modify their portfolios – trading from one asset to another and deferring capital gains, so long as they meet the guidelines outlined by the Internal Revenue Service (IRS).

What is a 1031 Exchange

A 1031 Exchange, also known as a tax-deferred exchange, enables a real estate investor to sell one property and exchange into another while deferring tax consequences.


Properties held for investment purposes – both residential and commercial – can qualify for a 1031 exchange. They include, but are not limited to, retail assets, office buildings, single-family homes, multifamily properties, and hospitality buildings. Any property used for personal use – such as a primary residence – does not qualify for a 1031 exchange.
